Terms of use

1. The Service

Sofia is a SaaS platform that helps small and medium businesses:

• Create social media content (posts, images, videos, Reels, stories) with AI assistance;
• Plan an editorial calendar across multiple social networks;
• Publish content to connected third-party accounts on the schedule you define;
• Measure performance through analytics dashboards based on metrics provided by each platform.

Sofia supports Instagram Business, Facebook Pages, X, LinkedIn, TikTok and Snapchat, subject to each platform's terms.

2. Eligibility & account

• You must be at least 16 years old and legally able to enter into a contract.
• You must use the Service for business purposes (B2B).
• You provide accurate information when creating your account and keep it up to date.
• You are responsible for safeguarding your password and for all activity under your account.
• Notify us at [email protected] of any unauthorised access.

3. Connection of third-party accounts

To publish or analyse content on social networks, you must connect your own accounts via the official OAuth flows. By connecting an account, you:

1. Authorise Sofia to perform, on your behalf, the specific actions permitted by the scopes you granted (e.g., publishing media on your Instagram Business account, reading basic profile information, reading insights of your own media);
2. Confirm that you have the legal right to manage the connected account and its content;
3. Agree that your use of each social network through Sofia is also subject to that platform's terms (Meta Platform Terms and Developer Policies, Instagram Platform Policy, Facebook Community Standards, X Developer Agreement, LinkedIn API Terms, TikTok for Developers Terms, Snap Kit Terms of Service);
4. Acknowledge that Sofia has no control over changes made by the social platforms and is not liable for restrictions, throttling or actions taken by them against your accounts.

You can disconnect any account at any time from Sofia → Settings → Connected accounts, or directly from the platform's "Apps and Websites" / "Business Integrations" page.

4. Your content & licences

4.1 Ownership

You retain full ownership of the content (text, images, videos, audio, brand assets) you upload to, generate in, or publish through Sofia ("User Content").

4.2 Licence to Sofia

You grant Sofia a worldwide, royalty-free, non-exclusive, non-transferable licence to host, store, reproduce, transmit, display, format, transcode and distribute User Content, solely to operate and provide the Service to you (including pushing the content to the social platform you targeted).

4.3 Your representations

• You own all rights to the User Content or have obtained the necessary licences (creators, photographers, models, brands, music rights, stock providers);
• User Content does not infringe any intellectual property right, right of publicity, privacy right, or other third-party right;
• User Content complies with applicable law and with the policies of each social network you publish to;
• User Content does not contain illegal, hateful, discriminatory, violent, defamatory, harassing, sexually explicit, or misleading material;
• You will not use the Service to publish spam, artificially inflate engagement, impersonate another person or brand, or engage in any other prohibited behaviour on the target platform.

Sofia reserves the right to remove or refuse to publish any User Content that we reasonably believe violates these Terms, applicable law, or a third-party platform's policy.

5. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to derive the source code of the Service;
• Circumvent rate limits, authentication, or any security mechanism;
• Use the Service to distribute malware or conduct phishing or fraud;
• Resell, sublicense, or use the Service to build a competing product;
• Use the Service to automate behaviours prohibited by a connected platform (e.g., mass fake engagement on Instagram);
• Access or use data from a social network account you are not legally authorised to manage.

6. AI-generated content

Sofia offers AI-assisted content generation. AI outputs may contain inaccuracies, biases, or factually incorrect statements. You agree that:

• You will review every AI-generated output before publishing it;
• You remain fully responsible for the content you publish;
• You will not generate content that infringes third-party rights or violates applicable law;
• Sofia provides no warranty as to the accuracy, completeness, or suitability of AI outputs.

7. Subscriptions, pricing & billing

Paid plans are offered on a subscription basis. Pricing and features are presented at sofia-post.com/pricing and at checkout. By subscribing, you authorise us (or our payment processor) to charge the applicable fees on a recurring basis until you cancel. You may cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period, with no pro-rata refund unless required by applicable consumer law.

8. Term, suspension & termination

These Terms apply for as long as you have a Sofia account.

You may delete your account at any time from Sofia → Settings → Account → Delete my account or by writing to [email protected]. Upon deletion, your data is handled as described in our Privacy Policy, section 8.

We may suspend or terminate your access without notice if you materially breach these Terms, violate applicable law, or expose Sofia or any third party to legal, security, or financial risk. We will attempt to notify you first whenever reasonably possible.

9. Intellectual property of the Service

Sofia, its logo, and all software, documentation, interfaces, models, prompts, and content that are not User Content are the exclusive property of Sofia or its licensors and are protected by intellectual property law. No provision of these Terms transfers to you any right to these elements beyond the limited right to use the Service.

10. Warranties & disclaimers

The Service is provided "as is" and "as available", without warranties beyond those that cannot legally be disclaimed. Sofia does not warrant that the Service will be uninterrupted, error-free, or free from vulnerabilities. Sofia does not warrant that the Service will achieve any specific business result (engagement, reach, sales).

11. Limitation of liability

To the fullest extent permitted by law:

• Sofia's aggregate liability for any claim arising out of or in connection with these Terms is limited to the amount you paid Sofia during the twelve (12) months preceding the event giving rise to the claim;
• Sofia is not liable for indirect, consequential, or incidental damages, including lost profits, lost data, or loss of goodwill;
• Nothing in these Terms limits liability for gross negligence, wilful misconduct, or any liability that cannot be limited under applicable law.

12. Indemnity

You agree to indemnify and hold Sofia harmless from any claim, loss, or damage arising from: (i) your User Content; (ii) your violation of these Terms; (iii) your violation of a third-party right; (iv) your violation of a connected social platform's terms.

13. Changes

We may update the Service and these Terms. Material changes will be notified by email and by an in-app banner at least 15 days before they take effect, unless required earlier for legal or security reasons. Continued use after the effective date constitutes acceptance.

14. Governing law & jurisdiction

These Terms are governed by French law. Any dispute will be submitted to the competent courts of Paris, France, without prejudice to mandatory consumer-protection rules.
